Wills in the Time of Covid-19

For many of us, this week marks around 10 weeks of pandemic living. Our lives have been affected in countless ways, different for each of us, more difficult for some than others, but undeniably impactful to all. Still, it’s important to make sure that we don’t allow important housekeeping matters to slip through the cracks while adapting to the current circumstances.

How Does This Work?

To properly execute a will in New York, you must sign in the presence of two witnesses, who typically sign an affidavit attesting to having just witnessed the signing. That affidavit is then notarized.  A New York trust is simply signed in front of a notary. Governor Cuomo has issued executive orders allowing these formalities to be discharged remotely over live videoconferences. There are a few extra hoops to jump through, but it’s a pretty simple process that we’ve been able to take care of without a problem.
